Purpose of the Association



The Association was created by statute and is subject to regulatory supervision of the Department of Insurance. The purpose of the Association is to make automobile bodily injury and property damage liability insurance required by the Texas Motor Vehicle Safety Responsibility Act available to eligible applicants, subject to the rules of the Association.

The Association has established procedures for the equitable distribution of applications for insurance to be assigned to insurance companies. All insurance companies (except ineligible county mutuals) authorized to write motor vehicle liability policies in the State of Texas must be members of the Association and participate in its operation.

The Association is governed by Chapter 2151 , Texas Insurance Code, and its Plan of Operation, which has been approved by the Commissioner of Insurance.

The average is determined by adding the first day of 2 consecutive quarters and dividing by 2. For Example:Company A: Dec 31, 2002 (1,000) + March 31, 2003 (1,200) ÷ 2. 1,000 + 1,200 = 2,200 ÷ 2 = 1,100 average vehicles for 1st Qtr 2003 The same calculation is shown for each company and quarter, plus the total is shown for all companies.

The territorial credits are shown below by company, by underserved credit amount. The computation of the averages are the same as shown on the previous page.

If a company generates a negative quota, set the company's basic quota to zero. Divide the remaining companies' basic quota by the sum of the remaining companies' basic quota.
